RECALLING Article 15(j) of the Convention on the International
Maritime Organization regarding the functions of the Assembly in relation
to regulations and guidelines concerning maritime safety and the prevention
and control of marine pollution from ships,
RECALLING ALSO resolution A.744(18) by
which the Assembly adopted the Guidelines on the enhanced programme
of inspections during surveys of bulk carriers and oil tankers (hereinafter
referred to as "the Guidelines"),
NOTING that the 1994 Conference of Contracting Governments
to the International Convention for the Safety of Life at Sea (SOLAS),
1974 (hereinafter referred to as "the Convention") adopted regulation XI-1/2 of the Convention to
make the provisions of the Guidelines mandatory,
RECOGNIZING that the numerous amendments made to the Guidelines
necessitated a comprehensive revision in order to ensure the effective
implementation of their provisions and to maintain the highest practical
level of safety,
HAVING CONSIDERED the recommendation made by the Maritime
Safety Committee at its eighty-ninth session,
1 ADOPTS the International Code on the Enhanced
Programme of Inspections during Surveys of Bulk Carriers and Oil Tankers,
2011 (2011 ESP Code), as set out in the annex
to the present resolution;
2 INVITES Contracting Governments to the Convention
to note that the 2011 ESP Code will become effective upon entry into
force of the associated amendments to chapter
XI-1 of the Convention;
3 REQUESTS the Secretary-General of the Organization
to transmit certified copies of the present resolution and the 2011 ESP Code, contained in the annex, to all Contracting
Governments to the Convention after the aforementioned amendments
to chapter XI-1 of the Convention
have been adopted;
4 ALSO REQUESTS the Secretary-General of the Organization
to transmit copies of the present resolution and the 2011
ESP Code contained in the annex to all Members of the Organization
which are not Contracting Governments to the SOLAS Convention after
the aforementioned amendments to chapter
XI-1 of the Convention have been adopted;
5 FURTHER REQUESTS the Maritime Safety Committee
to keep the Code under review and update it as necessary, in the light
of experience gained in its application.
