1 Each Party shall establish legislation, regulations,
and standards that are necessary to ensure that Ship Recycling Facilities
are designed, constructed, and operated in a safe and environmentally
sound manner in accordance with the regulations of this Convention.
2 Each Party shall establish a mechanism for authorizing
Ship Recycling Facilities with appropriate conditions to ensure that
such Ship Recycling Facilities meet the requirements of this Convention.
3 Each Party shall establish a mechanism for ensuring
that Ship Recycling Facilities comply with the requirements of this
chapter including the establishment and effective use of inspection,
monitoring and enforcement provisions, including powers of entry and
sampling. Such a mechanism may include an audit scheme to be carried
out by the Competent Authority(ies) or an organization recognized
by the Party, taking into account guidelines developed by the Organization,
and the results of these audits should be communicated to the Organization.
4 Each Party shall designate one or more Competent
Authorities and the single contact point to be used by the Organization,
Parties to this Convention and other interested entities, for matters
related to Ship Recycling Facilities operating within the jurisdiction
of that Party.
