General policy

Agreement

A new agreement has been signed between The State Maritime Administration of the Republic of Azerbaijan and Recognised Organisation (RO) and enters into force on the 02nd November 2016. (Refer to Agreement governing the delegation of statutory certification to Annex 2 to the Agreement.)

Authorizations for services outside the scope of Appendix 1 to this Agreement will be dealt with, as mutually agreed and authorized by the Administration on a case by case basis.

Interpretations, Equivalents and Exemptions

While interpretations of the applicable instruments, as well as the determination of equivalents or the acceptance of substitutes to the requirements of the applicable instruments are the prerogative of the Administration, Recognised Organisation (RO) will cooperate in their establishment, as necessary. Recognised Organisation (RO) can apply the IMO interpretations and Circulars, as well as the available ICAS Unified Interpretations, unless provided by the Administration with written instruction to apply a different interpretation.

Exemptions from the requirements of the applicable instruments shall be the prerogative of the Administration and must be approved by the Administration prior to issuance.

In instances where, temporarily, the requirements of an applicable instrument cannot be met under particular circumstances, Recognised Organisation (RO) will, after consulting with and gaining approval from the Administration, apply such measures or supplementary equipment as may be available to permit the ship to proceed to a suitable port where permanent repairs or rectifications can be effected or replacement equipment fitted.

Reporting to the Administration

Before granting an extension of recommendations of major importance to the safety of ship, the Administration shall be informed.

The Administration is to be informed by writting if a ship or a floating unit is discovered to be operating with faults or defects, so that the ship is not fit to proceed to sea.

For reporting to the Administration to be carried out by Recognised Organisation (RO) Kazakhstan, refer to Appendix 2 to the Agreement (Annex 2 to the Agreement).
