General Policy

Agreement

An agreement has been signed between Nigerian Maritime Administration and Safety Agency (NIMASA) and Recognised Organisation (RO) SA. It enters in force on 24th January 2022.

The Agreement and its Annexes are displayed in Agreement governing the delegation of Statutory verification and Certification Services to Appendix 3 to the Agreement

Surveys and issuance of certificates

Statutory Surveys and Issuance of relevant certificates, except for Tonnage and ISM and ISPS Code and MLC and Regulation (EU) No 1257/2013 on Ship Recycling certification, are limited to ships classed with Recognised Organisation (RO).

Electronic certificates

Recognised Organisation (RO) is authorized to issue electronic certificates to Nigerian flagged vessels on its behalf in line with the standards stipulated in IMO’s Guidelines for the use of Electronic Certificates (FAL.5/Circ.39/Rev.2).

Interpretations, equivalents and exemptions

While interpretations of the applicable instruments, as well as the determination of equivalents or the acceptance of substitutes to the requirements of the applicable instruments are the prerogative of the Administration, Recognised Organisation (RO) will co-operate in their establishment as necessary. Recognised Organisation (RO) applies the IMO Interpretations and Circulars, as well as the available IACS Unified Interpretations, unless provided with written instruction to apply a different interpretation by the Administration.

Requests for interpretations, equivalents and exemptions must be signed by the owner of the ship including MODU/FPSO/FSO and forwarded to Recognised Organisation (RO), who shall process the request and make their well-founded recommendations including all relevant documentation, calculations, any yardstick employed to the Administration.

In granting the request, the Administration may add conditions or comments to the recommendations made by Recognised Organisation (RO).

Exemptions from the requirement of the applicable instruments must be approved by the Administration prior to issuance.

In instances where, temporarily, the requirements of an applicable instrument cannot be met under particular circumstances, proposals for such measures or supplementary equipment as may be available to permit the ship to proceed to a suitable port where permanent repairs or rectification can be effected or replacement equipment fitted are to be acceptable to Recognised Organisation (RO) and agreed by the Administration.

Recognised Organisation (RO)’s surveyor shall furnish the ship with a signed statement describing the measures or supplementary equipment specified and the time limit for permanent repairs or rectification. A copy of this statement shall be forwarded to the Administration for information.

Reporting

Deficiencies

Recognised Organisation (RO) shall, within 2 business days, inform the Administration when a ship is found to be in operation with deficiencies or discrepancies, such that the condition of the ship or its equipment does not correspond substantially with the particulars of its certificates or the requirements of applicable international conventions and/or national regulations such that, in the opinion of Recognised Organisation (RO), the ship is not fit to proceed to sea without danger to the ship, persons on board, or an unreasonable threat of harm to the environment; and if corrective action is not taken to the satisfaction of Recognised Organisation (RO), then Recognised Organisation (RO) shall withdraw the relevant certificates and so inform the Administration.

Initial survey

Recognised Organisation (RO) shall, as soon as possible after completing the initial survey and inspection functions send the Administration a confirmation to the effect that the ship complies with the relevant requirements and that all reports on initial surveys of the same requirements have been received, controlled and filed.

Further, a copy of general arrangement drawings shall be submitted for ships that have not previously been registered in the Administration's Register of Ships.

Furthermore, for ships with a length (L) above 24 meters but below 500 GRT, a copy of the Load Line initial survey reports and freeboard calculations shall be submitted to the Administration.

Change of RO

In the event that a ship classed with one RO expresses the desire to change to another RO, the provisions in MSC-MEPC.5/Circ.2 must be complied with.

In such case, the new RO shall ensure that it has obtained all relevant information on the survey status of the ship, including structural and operational limitations and outstanding recommendations/conditions given by the previous recognized organization. The structural and operational limitations of the ship shall be checked during class entry survey and agreed to by RO.

If the ship is not under class, the same shall apply when a ship leaves one RO in order to register with another RO. Outstanding recommendations/conditions given by the previous organization, known by RO, shall be followed up by the new RO within the time limits given by the previous organization. The foregoing procedures shall be carried through before assignment of class to a ship, or before a non-classed ship is registered with RO. This information mentioned above shall also be made available to the Administration and for vessels leaving the RO, the same kind of information shall be submitted to the recipient RO upon request.

Cargo Ship Safety Construction Certificate

Recognised Organisation (RO) is fully authorized for survey and issuance of Cargo Ship Safety Construction Certificate.

Cargo Ship Safety Equipment Certificate

Recognised Organisation (RO) is authorized for survey and issuance of Cargo Ship Safety Equipment Certificate, for initial survey only.

Cargo Ship Safety Radio Certificate

Recognised Organisation (RO) is authorized for survey and issuance of Cargo Ship Safety Radio Certificate, for initial survey only.

Passenger Ship Safety Certificate

Recognised Organisation (RO) is fully authorized for survey and issuance of Passenger Ship Safety Certificate.

Others

IGC Code

Recognised Organisation (RO) is fully authorized for survey and issuance of International Certificate of Fitness for ships built on or after 1 July 1986.

IBC Code

Recognised Organisation (RO) is fully authorized for survey and issuance of International Certificate of Fitness for ships built on or after 1 July 1986.

IMDG Code

Recognised Organisation (RO) is fully authorized for survey and issuance of Document of Compliance with the Special Requirements for Ships Carrying Dangerous Goods.

MODU Codes

For MODU Codes – Mobile Offshore Drilling Units – 1979 Code, 1989 Code an 2009 Code, Recognised Organisation (RO) is authorized for initial survey only.

High Speed Craft

Recognised Organisation (RO) has partial authorization for survey and issuance of Safety Certificate for High Speed Craft.

Offshore Supply Vessels

Recognised Organisation (RO) is fully authorized for survey and issuance of:

• Document of Compliance OSV according to Resolution MSC.235(82)

• Certificate of Fitness according to IMO Res.A.673(16)

Polar Code

Recognised Organisation (RO) is fully authorized for survey and issuance of Polar Ship Certificate.

MARPOL 73/78

Annex I - IOPP Certificate
